General terms and conditions of the service

1. FIELD OF APPLICATION / GENERAL

    Dolce Vita Shop by Yuliya Tramonte, via Valletta 3 CH-6900 Lugano, Switzerland (hereinafter Dolce Vita Shop), based in Lugano, operates an online shop.

    The offer is aimed at adult individuals with domicile as well as legal entities based in Switzerland. The delivery area is limited to the territory of Switzerland.

    These GTC regulate all steps of the purchase process that take place via the online shop, in particular the registration and storage of customer data, ordering, delivery, payment, customer service as well as complaints and use of customer data.

    The use of customer data is regulated in the data protection declaration. We expressly refer to the data protection declaration, which is an integral part of these GTC.

     

     

    2. REGISTRATION

      Registration in the online shop is reserved exclusively for persons capable of understanding and wanting. To place an order in the online shop, the customer can identify himself in the online shop with his e-mail address and password.

      If the customer orders for the first time in the online shop and does not yet have an online account, at the time of the first order he will be asked to create a user account and enter the necessary data, it is still possible to place the order without making the registration. The data provided by the customer, necessary for registration, must be complete and truthful. It is up to the customer himself to update his data. Registration is free. There is no entitlement to admission to the online shop.

      The customer undertakes to protect access to his user account and not to disclose the password used for access to third parties.

      Several times a year, e-mails with the latest news or special promotions may be sent to the e-mail address indicated at the time of registration. The customer can unsubscribe from this service at any time by clicking on the respective link at the bottom of the email.

       

       

      3. ORDERING

        How do I place orders?

        Only online orders are placed in the online shop.

         

        3.1. Assortment and product information

        Dolce Vita Shop is committed to correctly reporting product information. The product information published in the online shop is updated regularly and with the utmost care. Exceptionally, this information may be different from what actually appears on the packaging. In these cases, the indications given on the packaging always prevail. Before use, however, the customer is required to always read the specific information on allergies, intolerances, diabetes, etc. indicated on the product packaging.

         

        3.2. Information on the origin of fresh products

        If, in the case of fresh products, the origin indicated at the time of the order does not correspond to that of the goods actually delivered or at the time of delivery it is no longer possible to identify the origin of the goods, the customer has the right to demand credit for the value of the goods in question.

         

        3.3. Intellectual property

        Dolce Vita Shop reserves the exclusive right to use all product descriptions, images, photos and texts.

         

        3.4. Ordering / conclusion of the contract

        The order is binding for the customer if he completes the online ordering process with the confirmation button «Send order». After clicking on the confirmation button, the customer can no longer change the content of the order. By clicking on the confirmation button, the customer confirms the correctness of all the information provided. By clicking on the confirmation button, the customer sends his binding offer for the purchase of the ordered products. Immediately after completing the ordering process, the customer will receive an order confirmation e-mail. This confirmation email from Dolce Vita Shop represents acceptance of the offer by Dolce Vita Shop. The contract between the customer and Dolce Vita Shop is to be considered finalized only after confirmation by e-mail.

        The customer has no right to have his offer accepted by Dolce Vita Shop. Dolce Vita Shop reserves the right to reject the order and refuse confirmation.

        Orders can be placed up to max. 10 days before the desired delivery date. Delivery windows of one hour can be reserved for the delivery service of the Dolce Vita Shop online shop.

         

        3.5. Modification and cancellation of orders

        Changing an order is only possible until the customer has completed the ordering process by clicking on the confirmation button «Send order». If the customer has clicked on the confirmation button and thus sent his offer to the Dolce Vita Shop, it is no longer possible to change the order.

        The customer can cancel orders confirmed by Dolce Vita Shop up to 36 hours before the delivery date. The 36 hours are valid if they fall entirely within working days.

        To cancel the order, the customer must contact Customer Service. Customer Service can be contacted via the following telephone number (+41) 079 930 25 82 .

        The cancellation is only valid if it is confirmed by Customer Service. The order can only be canceled during the opening hours of the Customer Service: from Monday to Friday from 8:00 to 20:00.

        Dolce Vita Shop reserves the right to cancel orders. In this case, the customer will receive notification by e-mail even before the delivery of the goods.

         

        3.6. Data exchange guarantees

        The current state of the art does not make it possible to guarantee error-free and effective data exchange over the Internet at all times. Dolce Vita Shop therefore does not guarantee the continuous and uninterrupted availability of the online store and is not liable for any errors of a technical and electronic nature that may occur during a purchase transaction. Dolce Vita Shop is not liable in particular for the processing or deferred acceptance of orders.

         

         

        4. DELIVERY

        4.1. SHIPPING COSTS

        Shipping throughout Switzerland via Post.ch and with variable price based on the weight of the parcel:

        • Up to 2Kg CHF 7
        • Up to 10Kg CHF 9.7
        • Up to 30Kg CHF 20.5
        • More than 30Kg CHF 50

        For orders costing more than CHF60 shipping is free .

         

        4.2. HOME DELIVERY

        Home delivery is not currently available.

         

        4.3. PICK UP AT OUR OFFICE

        It is possible to collect the order directly at our office at no cost. Before making the withdrawal, we ask you to call to have everything ready. It is not a shop open to the public, by appointment only.

         

          4.4. Delivery of the ordered products

          The ordered products will be delivered to the delivery address provided by the customer.

          Depending on the range and delivery location, the delivery is carried out by Dolce Vita Shop's own delivery service or by one of the various delivery service partners. Delivery is made for individuals at the door of the house and for companies at the respective reception.

          For reasons of quality and safety, Dolce Vita Shop aims to deliver the goods personally to the customer. The customer can specify where the delivery should be deposited if he is absent. In the case of delivery by a delivery service partner, the goods are deposited at the delivery address, usually in front of the house door, in the absence of the customer or the contact person indicated by him.

          When the goods are delivered to the customer or stored, the related benefits and dangers - including, in particular, the risk of theft or damage by third parties or damage caused by atmospheric agents - pass to the customer

           

          4.5. Delivery times and compliance with delivery terms

          Dolce Vita Shop and its partners make every possible effort to respect the delivery terms. However, all delivery times announced by Dolce Vita Shop are purely indicative. Non-compliance with the delivery terms by Dolce Vita Shop and its delivery partners does not entitle the customer to withdraw from the contract or to request compensation.

           

          4.6. Inability to deliver

          If Dolce Vita Shop and its delivery partners are unable to deliver an order confirmed by Dolce Vita Shop, the latter is not obliged to deliver otherwise. In this case the order will be canceled by Dolce Vita Shop. The customer will be notified by e-mail.

          In this case, the customer has no right to compensation.

          The customer is required to provide truthful information and to comply with its provisions. If the customer violates these provisions and Dolce Vita Shop cannot deliver the order for this reason – the customer's address is incorrect or the customer cannot be found at home even though he does not want the Dolce Vita Shop delivery service to deposit the goods on your door – Dolce Vita Shop is entitled to cancel the order and to request an administrative fee of CHF 50.00.

           

          4.7. Incomplete fulfillment of the order

          Dolce Vita Shop is committed to supplying all ordered products in sufficient quantities and in high quality. Nevertheless, in exceptional cases it may happen that, for a variety of reasons, the available goods are not sufficient or that it is not possible to authorize their delivery. Dolce Vita Shop therefore reserves the right to make partial deliveries. In this case, the customer will receive notification by e-mail even before the delivery of the goods.

          Products not available at the time of delivery will be shipped later.

           

          4.8. Delivery costs

          Delivery costs are indicated at the time of ordering. The amount of the delivery costs varies according to the delivery method chosen, the value of the order net of any vouchers and discounts and the frequency of ordering. A minimum order value may apply depending on the range and delivery method.

           

          4.9. Delivery note and invoice

          Delivery notes and invoices are usually sent electronically.

           

           

          5. PRICES AND PAYMENT

            5.1 Prices

            All prices are in Swiss francs and include the applicable value added tax. The prices indicated at the time of ordering on the website of the online shop are always valid.

             

            5.2. Payment methods and terms

            There are different payment methods depending on the assortment and type of shipment. Dolce Vita Shop is in any case authorized to establish at its own discretion which means of payment to accept in the individual specific case.

            The different payment options are:

            - credit card,

            - TWINT,

            - PayPal.

             

            For legal entities, the method of payment "on invoice" is only available upon written request (invoice request for companies or invoice request for public organizations and institutions).

            The accepted payment options are offered to the customer during the ordering process.

            If at the time of ordering the customer is in arrears with the payment of previous invoices or if his personal credit limit is exceeded, the possibility of opting for payment «by invoice» ceases to exist.

            The invoices are sent after delivery, possibly in electronic form, or by post to the address indicated by the customer or directly enclosed with the goods being delivered. Invoices must be paid within 30 days of receipt, without deductions or discounts. The amount of any unauthorized deductions is subsequently charged. In the event of late payment, a fee of CHF 20.00 will be charged and default interest of 5% pa from the due date will be applied.

             

            5.3. Credit check / Creditworthiness

            Dolce Vita Shop is entitled to make the delivery of orders subject to a credit check.

            With the order, Dolce Vita Shop is expressly authorized by the customer to carry out a credit check at its own discretion and, if necessary, to pass on customer data to third parties for this purpose.

             

            5.4. Debt collection and assignment of credits to third parties

            In the event of default by the customer, Dolce Vita Shop is entitled to entrust the recovery of outstanding payments to third parties as well as to assign claims to third parties in Switzerland and abroad. In the event of an assignment, all claims not paid at this time must be assigned. The resulting costs are borne by the customer. Additional costs can be found here.

             

             

            6. SPECIAL PRODUCTS

              6.1. Dolce Vita Shop gift cards

              For the purchase of Dolce Vita Shop gift cards, the corresponding Dolce Vita Shop General Terms and Conditions also apply.

               

               

              7. CUSTOMER SERVICE AND COMPLAINTS

                7.1. Contact

                Any defects must be reported immediately upon arrival of the goods. Otherwise the goods are considered accepted by the customer and in perfect condition. Any hidden defects that may be present must be reported to Customer Service as soon as they are discovered.

                If the complaint is justified, the purchase price will be refunded to the customer. The type of refund of the purchase price depends on the chosen payment method. For certain means of payment, the customer receives the amount due in the form of a gift card. This solution applies in the event that it is not possible to make a refund with the selected payment method or a reversal on it.

                 

                 

                8. FINAL PROVISIONS

                  8.1. Contradictions between languages

                  In the event of inaccuracies and/or discrepancies between the German, French, Italian and/or English versions of the General Terms and Conditions, the Italian version shall prevail.

                   

                  8.2. Modification of the GTC

                  Dolce Vita Shop reserves the right to modify these GTC at any time. The changes will be announced on the website of the online store and will take effect upon online activation. With the first order after activation of the new GTC, the customer accepts the new provisions.

                   

                  8.3. Severability clause

                  Should parts of these GTC prove to be unenforceable or invalid, this does not affect the validity of the remaining provisions.

                   

                  8.4. Applicable law and competent court

                  Only Swiss law applies. For natural persons, the competent court is that of Lugano or the locality where the customer is domiciled. For legal persons, the Lugano court is exclusively competent.
